1.Introduction

Please read these terms carefully before using the Toecan mobile application or any of its associated services. By installing, registering, or using the app you confirm that you have read, understood, and agree to these Terms & Conditions and to our Privacy Policy.

If you do not agree, please do not install or use the application.

2.General information

The Toecan mobile app is provided by Toecan BV, Gistelse Steenweg 302/1, 8200 Bruges, Belgium. Use of the application constitutes a binding agreement between you (the user) and Toecan.

Any changes to these terms will be communicated through the application or via email. Continued use of the application after such changes implies your acceptance of the new terms.

3.Definitions

Toecan — Toecan BV, the service provider.

User — any person who installs, registers in, or uses the application.

Application — the Toecan mobile app available on iOS (via the App Store) and Android (via Google Play).

Toecan platform — the combined infrastructure of the application, the back-end services, the algorithms, and the supporting software that processes user trip data.

Trip — a period of vehicle movement automatically detected and recorded by the application.

Driving score — the personal performance indicators (safety, eco, speed, phone distraction) calculated by the platform from a user's trips.

4.Scope of application

The application automatically records driving behavior, location, vehicle movement, and related trip statistics. Recorded data is processed in pseudonymised form within the Toecan platform unless otherwise agreed in writing.

Compatibility

  • iOS 15.0 or later
  • Android 8.0 (API level 26) or later

Toecan does not warrant that the application will function on devices that fall outside the compatibility list above, or on devices whose operating system has been modified (e.g. rooted or jailbroken).

5.Registration & account

To use the application you must register an account using the login code provided to you by Toecan or by your fleet administrator. You agree to:

  • Provide accurate, current and complete information at registration.
  • Not use the application for any illegal purpose.
  • Respect the reputation of Toecan and of other users.
  • Comply with all applicable local traffic and data-protection laws.
  • Follow any instructions issued by your employer where the application is used in a professional context.
  • Choose a non-offensive username and protect the confidentiality of your login code.
  • Take full responsibility for your own driving behaviour and for the compatibility of your device with the application.

6.Use of the application

You must operate your vehicle responsibly at all times. Do not interact with your phone or the application while driving. Trips are recorded automatically in the background — no in-trip interaction is required or recommended.

For the application to function correctly, you must grant it active access to:

  • Location (including background location)
  • Motion and activity sensors
  • Bluetooth (optional but recommended)
  • Notifications
  • Network connectivity (Wi-Fi and/or mobile data)

Closing the application or revoking the above permissions during a trip will prevent trips from being recorded correctly.

7.User obligations

You may install one copy of the application on a device that you personally use. The following activities are strictly prohibited:

  • Circumventing or attempting to circumvent any security mechanism of the application or platform.
  • Reverse-engineering, decompiling, or disassembling the application.
  • Copying, modifying, redistributing, renting, leasing, sub-licensing, or commercially exploiting the application or any part of it.
  • Using the application to harvest data about other users.
  • Using the application in any way that could damage, disable, overburden, or impair the Toecan platform.

8.Privacy & data processing

Toecan processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and any other applicable data-protection legislation. The categories of data processed, the purposes, the retention periods, and your rights as a data subject are described in our Privacy Policy.

Pseudonymised data may be used for service improvement, statistical analysis, and academic research. Personal data will not be shared with third parties except where necessary to provide the service (e.g. cloud infrastructure providers), or where required by law.

9.Intellectual property

The application, its source code, the back-end software, the algorithms, the texts, the visuals, the trade marks and the names "Toecan" remain the exclusive property of Toecan BV or its licensors. Nothing in these terms transfers any intellectual-property right to you.

Reproduction, distribution, publication, or commercial use of any part of the application without the prior written consent of Toecan is prohibited. Decompiling the application or creating derivative works based on it is strictly prohibited.

10.Disclaimer of liability

The application is provided on an "as is" and "as available" basis. Toecan does not warrant that the application will be uninterrupted, error-free, or free of vulnerabilities.

Toecan is not liable for any damage to your vehicle, smartphone, accessories, or any other property arising from your use of the application. Driving behaviour and compliance with traffic regulations remain entirely your own responsibility.

11.Termination

Toecan reserves the right to suspend or terminate your access to the application in the event of misuse, fraud, breach of these terms, or any conduct that may harm Toecan, other users, or third parties.

You may stop using the application at any time by uninstalling it from your device. You may request deletion of your personal data in accordance with the procedure set out in our Privacy Policy.

12.Maintenance & support

Toecan is under no obligation to maintain the application, to provide updates, or to provide ongoing support. Where updates are issued — either as separate downloads or as automatic in-app updates — your continued use of the application after the update implies your acceptance of any change.

13.Applicable law & disputes

These terms are governed by Belgian law. Any dispute arising out of or in connection with these terms or the use of the application that cannot be resolved amicably will be submitted to mediation in accordance with the WIPO Mediation Rules. The seat of the mediation will be Brussels. The language of the mediation will be Dutch or English, at the choice of the party initiating it.

If mediation fails, the dispute will be subject to the exclusive jurisdiction of the courts of Bruges, Belgium.
